Hi parents! Thanks for joining Marble, a voice-based thought partner designed to spark creativity, curiosity, and learning for children and their families. Marble is operated by Generative Spark Inc., based in Delaware, USA. These Terms explain how Marble works, what's expected of you and your family, and how we keep everyone safe.

By creating an account or allowing a child to use Marble, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.

1. Who These Terms Apply To

These Terms apply to all parents or legal guardians ("you") who register an account with Marble and to the children ("kids" or "child users") invited to use Marble under that account.

1.1 Parents and Guardians

Marble accounts may only be created by a parent or legal guardian ("Parent"). Parents are responsible for all activity conducted by child users under their account.

1.2 Child Users

Children may only use Marble under a Parent account and with verifiable parental consent.

1.3 Eligibility

You represent that you are legally able to enter into these Terms and that all information you provide is accurate.

2.1 Verifiable Parental Consent

Marble requires verifiable parental consent in accordance with applicable laws, including COPPA, GDPR, and UK GDPR. The service uses email-plus parental consent verification.

3. What Marble Is

Marble is a voice-based thought partner available on web and iOS. It helps children explore ideas, learn skills, and express creativity through interactive conversations and visuals. Marble also offers a parent experience, helping grown-ups stay connected with their child's progress and creative moments.

3.1 No Professional Advice

Marble does not provide medical, psychological, legal, or educational certification services. Content generated is for informational and creative purposes only.

4. Voice, Privacy and Safety

Marble is a voice-based service, so, like Siri, Alexa, or any voice assistant, it listens and responds in the moment to talk with your child. To help your child reflect on their learning and to keep them safe, their conversation history is securely stored and encrypted. It is never sold, never used for advertising, kept only while the account is active, and permanently deleted when you close the account. Parents can delete it at any time.

Children can upload photos to share their work with Marble. Photos should be of objects, artwork, projects, or other creations — not of people. Marble automatically screens uploaded images and will reject photos that appear to contain people; rejected images are not stored. Photos of work that are successfully uploaded are retained for the life of the account to support learning reflection and continuity, and are deleted when the account is closed. Parents may request deletion of specific photos at any time. The service also uses image generation features that may include your child's creative input.

4.2 Data Minimisation and Retention

We apply data minimisation principles and retain personal data only as long as reasonably necessary for the purposes described in our Privacy Policy or as required by law.

4.3 Model Improvement

Marble may use aggregated and anonymised data to improve the Service. The company does not use identifiable children's data for model training beyond what is permitted by applicable law and the Privacy Policy. Parents can review or delete their child's data anytime by contacting support@withmarble.com.

5. Accounts and Security

Parents are responsible for safeguarding account credentials and for all activity under their account. Please keep your account details safe. If you think someone else is using your account, contact the support team right away at support@withmarble.com.

6. Subscriptions and Payments

Marble offers recurring subscriptions, which may be purchased directly through our website or the Apple App Store. Payments are processed securely by third-party partners like Stripe.

6.1 Recurring Charges

By purchasing a subscription, you agree to recurring charges until you cancel. You can manage or cancel subscriptions at any time through your Marble account or the App Store settings.

6.2 Free Trials and Promotions

The company may offer free trials, promotions, or discounts from time to time.

6.3 Refunds

Unless stated otherwise, all paid subscriptions are non-refundable once a billing period has started, except as required by law.

7. Safe and Respectful Use

Marble is meant to be a positive and safe space. You and your child agree not to:

8. Intellectual Property

8.1 Marble IP

Everything in Marble (like its software, design, art, and voice content) belongs to Generative Spark Inc. or our partners. You can use Marble for your family's personal, non-commercial enjoyment.

8.2 User Content

Creative content made by your child within Marble (like stories, drawings, photos, or ideas) belongs to your family. By using Marble, you grant the service a non-exclusive, worldwide, royalty-free license to use, store, and process such content solely to operate and improve the Service.

8.3 AI-Generated Content

Content generated by Marble may not be unique and may be similar to content generated for other users. Marble makes no warranties regarding originality or non-infringement.

9. Safety and Moderation

Marble is committed to providing safe, age-appropriate content for children. The company employs multiple layers of automated and human moderation and continuously works to improve safety measures. If you encounter concerning content, please report it to safety@withmarble.com. While the company strives for safety, Marble is an AI-powered service and we do not guarantee that all content will be accurate.

10. Ending or Changing Your Account

Parents can cancel their subscription or delete their account at any time. Marble may also suspend or close accounts that break these Terms or any laws. We may update or change Marble's features or these Terms occasionally. When this happens, an updated version will be posted with the new effective date. Continued use of the Service constitutes acceptance of the updated Terms.

11. Disclaimer of Warranties

Marble is provided on an "as is" and "as available" basis. While the company works hard to make it safe, fun, and reliable, they cannot promise it will always work perfectly or be free from interruptions. To the maximum extent permitted by law, Marble disclaims all warranties, express or implied.

12. Limitation of Liability

Generative Spark Inc. is not responsible for losses or damages that happen because of technical issues, internet outages, or misuse, except where required by law. To the maximum extent permitted by law, Marble shall not be liable for indirect, incidental, consequential, or punitive damages. Marble's total liability shall not exceed the amounts paid by you to Marble in the twelve (12) months preceding the claim. Nothing in these Terms limits liability that cannot be excluded under applicable law.

13. Dispute Resolution

13.1 United States Users

If a dispute arises that we can't resolve informally, it will be handled by binding arbitration through the American Arbitration Association (AAA) under its Consumer Arbitration Rules, using Delaware law. Arbitration means both parties agree not to go to court (except for small-claims matters) and not to join any class-action lawsuit. You may still bring a claim in your local small-claims court if it qualifies.

13.2 EU/UK Users

For EU and UK users, mandatory consumer protection laws apply. Courts of your country of residence may have jurisdiction where required by law.
